Terms and Conditions
The ticket sale and participation in the Eurekaweek itself are subject to the terms and conditions beneath. Please read these carefully and contact us if you have any questions regarding the contents.
Note: Erasmus University Rotterdam has translated the Dutch General Terms and Conditions into English to make them more accessible for international students. The Dutch General Terms and Conditions are leading in any case.
Article 1 – Definitions
1. Visitor: Participant, Guide, students in higher study years and other parties that visit and/or participate in the Events.
2. Participating parties: Parties with which the Organisation has contracted a partnership for the Eurekaweek. These include student parties, such as student and study associations, student sports associations, sponsors and partners.
3. Participant: A student (a natural person) who is starting a new Bachelor’s, pre-Master’s or Master’s degree course at Erasmus University Rotterdam and has registered for participation in the Eurekaweek.
4. Eurekaweek: The general introduction week organised by Erasmus University Rotterdam for students starting a new Bachelor’s, pre-Master’s or Master’s degree course at Erasmus University Rotterdam.
5. Eurekaweek management: The team within Erasmus University Rotterdam that is primarily responsible for the implementation and/or coordination of the organisation of the Eurekaweek, under the auspices of the Head of Student Facilities of Erasmus University Rotterdam.
6. Event: Every activity organised by the Organisation as part of the Eurekaweek which is open to or accessible to Participants and/or Guides.
7. Guide: Student in a higher study year who is appointed as a Guide for Participants by the Eurekaweek management.
8. Organisation: Erasmus University Rotterdam and all persons, committees and volunteers (including the Eurekaweek management) appointed by Erasmus University Rotterdam to implement and/or coordinate the organisation van the Eurekaweek under its responsibility.
9. Security services: The persons and/or organisations responsible for ensuring safety during the Eurekaweek. These include: The Police, Fire Service, Security officers and First Aid officers (including drugs-related incidents).
Article 2 – Applicability of the General Terms and Conditions for Participation in Eurekaweek
1. These General Terms and Conditions for Participation in Eurekaweek apply to Participants in the Eurekaweek and Visitors to the Events. The General Terms and Conditions for Participation in Eurekaweek are available on the eurekarotterdam.com website. The General Terms and Conditions for Participation in Eurekaweek are also included in the official registration form, which can be read prior to confirmation of participation in the Eurekaweek.
Article 3 – Registration and participation in/access to Eurekaweek (Events)
1. Following correctly completed registration and successful payment of the registration fee via the registration medium made available by the Organisation, the Participant will receive proof of registration in the form of a QR code sent to the e-mail address given by the Participant.
2. The Participant receives one Eurekaweek wristband, solely on presentation of original proof of registration and a valid identity document.
3. Access to and participation in the Events is open to Participants only if they wear the required unbroken/intact and undamaged Eurekaweek wristband. For certain Events, the Organisation may also set the additional condition that the Participant must report or register for this separately in advance.
4. The Participant must show the required Eurekaweek wristband at the request of the Organisation and/or the security services. If the Participant refuses to do so, he/she may be denied access to and/or participation in a Eurekaweek event without the right to a full or partial refund of the registration fee.
5. The Eurekaweek wristband is also an age wristband, identifiable by the colour and the 18- marking. Participants aged over 18 receive a wristband with a different colour and marking.
6. The Eurekaweek wristband is strictly personal and non-transferable.
7. In the event of fraud with and/or other unlawful use of the Eurekaweek wristband by the Participant, the Participant will be excluded from the entire Eurekaweek and all Events, with no right of a refund of the registration fee or entrance charge.
8. In the event of damage to the Eurekaweek wristband, because it is no longer unbroken/intact and/or the colour is no longer clear and/or the text on the wristband is no longer legible, the wristband is no longer valid. Only if the damage arose through no fault of the Participant (as determined by the Organisation) can the Participant, on presentation of a valid identity document and proof of registration and after submission of the damaged but complete Eurekaweek wristband, receive a new Eurekaweek wristband at the Service Point free of charge. In all other cases, €20.00 will be charged for administrative costs in order to obtain a new Eurekaweek wristband, provided that the Participant can show a valid identity document and proof of registration. If the Participant hands in the damaged but complete Eurekaweek wristband to the Organisation, €10.00 will be deducted from the administrative costs as a discount.
9. Returns of registration and/or access/entry documents or refunds of registration fees and/or entry charges are possible up to 31/07/2023. Notification of the return of the Eurekaweek ticket must be sent to the Eurekaweek management in writing, by sending an e-mail to eureka@eur.nl.
4 – Eurekaweek House Rules for all locations and Events
1. The house rules form an inseparable part of these General Terms and Conditions for Participation in the Eurekaweek. Participants and Visitors must comply with these house rules, or exclusion with no right to a refund of the registration fee or entrance charge may follow.
2. Participants and Visitors must be in possession of a valid identity document.
3. Smoking is not permitted at the site of the Events.
4. You may not bring with you professional (digital) cameras, cameras with a lens of >70 mm or video and/or audio equipment.
5. In certain cases, objects may be kept and returned when the owner leaves the location, at the discretion of the Organisation and/or the security officers.
6. No (alcoholic) drinks, dangerous objects (such as weapons, fireworks, aerosol cans, sprays, tin, glass, etc.) or food may be taken into Events. These will be confiscated and if necessary, will be handed over to the police and will not be returned.
7. Trading in, use or possession of any form of drugs is not permitted. These will be confiscated and handed over to the police and will not be returned. If trading in, use and/or possession of drugs is observed, exclusion from the Eurekaweek may follow, with no right to a refund of the registration fee or entrance charge.
8. No pets, other animals or bicycles may be taken to or into the location, with the exception of necessities in relation to a functional handicap. The Participant should contact eureka@eur.nl in that regard.
9. The Organisation has the right to provide for Visitors to Events and their bags to be searched before entry and/or during Events. Visitors who do not accept this may be denied entry to the Event or be immediately removed, with no right to a refund of the amount of the registration fee or entrance charge.
10. Cameras may be present which will take recordings at the site/location of the Event in connection with surveillance and security.
11. Participants and Visitors must follow the directions, instructions and prohibitions of the Organisation and/or the security service, or entry will be denied.
12. Participants and Visitors may not jeopardise public order and safety in any way whatsoever, or entry will be denied.
13. Expressions that the Organisation regards as offensive or undesirable, on clothing, in texts or on signs, are not permitted. If this is the case, entry will be denied.
14. If Participants and Visitors show undesirable conduct (including bullying, sexual harassment, aggression, violence, threats, stalking, unequal treatment and discrimination), entrance will be denied. No refunds of entrance charges will be made on denial of entry.
15. Vehicles/bicycles must be parked in the spaces designated for that purpose. Incorrectly parked vehicles/bicycles will be removed. The Organisation is not liable for damage of any form whatsoever caused by the removal of incorrectly parked vehicles/bicycles.
16. Climbing attributes or scaffolding is prohibited.
17. Photographs or videos showing Participants and Visitors may be posted on an ‘open source’ (internet, social media. etc.).
18. Unless otherwise agreed with the Eurekaweek management, sales or promotion of products and/or services at and/or within the sight of the Eurekaweek sites is not permitted.
19. The Organisation reserves the right to deny Participants and Visitors access or participation if they fail to follow the measures and/or instructions of the Organisation, or to do so correctly.
20. In situations for which the house rules make no provision, the Organisation will decide. The decision of the Organisation in that regard is binding.
5 – Alcohol policy
1. Participants and Visitors must comply with the Dutch Licensing and Catering Act (Drank- and Horecawet) during the Eurekaweek. This means that persons aged under 18 many not possess or consume any alcohol. Participants and Visitors are deemed to be aware of the provisions of this Act.
2. Alcohol may be ordered from catering points of the Eurekaweek only with an 18+ Eurekaweek wristband. Alcohol may only be served within the serving hours laid down by the Organisation.
3. Alcohol may not be fetched for, served to and/or provided to Participants with an 18- Eurekaweek wristband, Visitors with an 18- age wristband or people with no age wristband.
4. If a Participant or Visitor acts in contravention of this Alcohol Policy, they will immediately be excluded from further participation in the Eurekaweek and all its Events, with no refund of registration fees or entrance charges.
5. Due to the risks and negative consequences of alcohol consumption among young people, the Organisation attaches great importance to responsible alcohol consumption. In the event of irresponsible alcohol consumption, the Organisation may decide to deny the Participants and Visitors concerned any further participation in the Eurekaweek and all its Events, with no refund of the registration fees. The Organisation determines whether irresponsible alcohol consumption has occurred. The decision of the Organisation in that regard is binding. 6 – Covid-19 and programme changes
1. The Organisation follows the guidelines of the National Institute for Public Health and the Environment (RIVM) in connection with the coronavirus (Covid-19) and reserves the right to impose all necessary measures, obligations and restrictions in connection with Covid-19 (according to the government, the licence granted for the Eurekaweek or the Organisation) on Participants and Visitors. These measures may in any event include, but are not limited to:
a. The obligation to submit a (recent, no older than 48 hours) negative Covid-19 test result;
b. The obligation to submit proof of vaccination;
c. The obligation to (arrange to) take a Covid-19 rapid test;
d. The obligation to show that a Participant or Visitor has been vaccinated or is in possession of a (recent, no older than 48 hours) negative test result for Covid-19 by wearing a wristband issued by the Organisation;
e. The obligation to wear a face mask;
f. The obligation to maintain a distance of 1.5 metres.
2. If changes to or tightening of measures, obligations and restrictions are necessary, the Organisation is authorised to implement these without prior notice.
3. Participants and Visitors are required to comply with all measures, obligations and restrictions imposed by the Organisation.
4. Participants and Visitors are also required to comply with all government measures relating to the coronavirus pandemic. These include but are not limited to a potential quarantine obligation, proof of vaccination and/or the obligation to submit a negative Covid-19 test result. If a Participant or a Visitor is unable to take part in the Eurekaweek and the Events as a result, this is at their own risk and expense.
5. The Organisation reserves the right to deny Participants and Visitors access or participation, with no right to refunds of registration fees or entrance fees, if Participants fail to follow the measures and/or instructions imposed by the Organisation or by the central government, including but not limited to those relating to the coronavirus pandemic, or fail to do so correctly.
6. All rights relating to the Eurekaweek programme are explicitly reserved. If the programme is changed (including the cancellation of the Eurekaweek), the Organisation will pay no compensation or refunds to Participants or Visitors. The foregoing also applies if part of the Eurekaweek programme has to take place digitally or on a smaller scale due to measures relating to the coronavirus.
7. The Organisation has the right at all times to decide to cancel the Eurekaweek on the grounds of serious or exceptional circumstances. In addition to situations of force majeure, ‘serious or exceptional circumstances’ refers to situations in which the safety of Participants and Visitors is at risk. In that case, insofar as reasonably possible, the Organisation will offer the Eurekaweek digitally or move it to a different date or location. The registration of the Participants and Visitors will in that case be adjusted in accordance with this new date and/or location. The Organisation will notify the Participants and Visitors of this without delay via the Organisation’s website.
8. The Organisation is in no case liable for damage suffered by the Participant or Visitor as a result of coronavirus measures imposed or altered by the government or the Organisation.
7 – Liability
1. Participation in the Eurekaweek takes place at the Participant’s own risk. The Organisation is not liable for any damage suffered by the Participant during participation in the Eurekaweek unless that damage is a direct consequence of intent or wilful recklessness on the part of the Organisation.
2. The Organisation is in no case liable for indirect damage, including consequential loss, non-material damage, loss of profit, loss of savings and/or damage through business interruption.
3. The Organisation is not liable for loss of, damage to and/or theft of property.
4. If the Organisation deploys subordinates, non-subordinates, assistants, third parties and/or other person in the organisation of the Event, directly or indirectly, all liability of the Organisation pursuant to Articles 6:76, 6:170, 6:171 and 6:172 of the Dutch Civil Code is ruled out and the Organisation is not liable for damage caused by such persons.
5. A Visitor who causes damage to (property of) the Organisation and/or the Eurekaweek/Event locations will be held liable for the damage and costs arising.
6. Visitors must provide for adequate accident and liability insurance.
7. Visitors shall indemnify the Organisation against all third-party claims relating to damage for which Visitors are liable to those third parties by virtue of law. Visitors shall reimburse the Organisation for all damage, including any legal fees incurred by the Organisation as a result of a third-party claim.
8 – Force Majeure
1. In the event of force majeure, in the broadest sense, including, for the purposes of these General Terms and Conditions, war, fire, storms/hurricanes, flooding, earthquakes, labour disputes, strikes, epidemics, pandemics, government rules and/or similar rules, embargoes and failure of suppliers, artists or other third parties to comply, or to do so in a timely manner, the Organisation has the right to reschedule the Event on a different date or at another location, or to cancel the Event.
2. The Organiser is not liable for damage arising as a result of cancellation or rescheduling, as referred to above. If an Event does not take place, and/or does not take place in full, or takes place at a different time and/or in a different way or with a different programme as a result of or because of force majeure, the Participants and Visitors may claim (replacement) access to another Event. In the event of force majeure, the Participant has no right to any refund of the registration fee or entrance charge.
9 – Property rights
1. Without the prior written consent of the Eurekaweek management, all commercial use of the name and/or logo of the Eurekaweek and/or the Organisation and/or the Events is strictly prohibited.
10 – Emergency contact person
1. The Organisation reserves the right at all times to notify the emergency contact person designated by the Participant if it considers this necessary, for example in the event of a violation of the General Terms and Conditions for Participation in Eurekaweek or the house rules, accidents, hospital admissions and/or emergencies.
11 – Final provisions
1. In the event of complaints and/or comments, an e-mail can be sent to eureka@eur.nl.
2. If one or more of these General Terms and Conditions for Participation in Eurekaweek are deemed to be null and void or voidable, partially or in full, by a competent court, the other (parts of the) provisions remain in force in full. In that case, the Organisation/the Eurekaweek management will establish a new provision to replace the provision that is null and void / has been voided, taking account of the purport of the provision that is null and void / has been voided as far as possible.
3. Derogation from these General Terms and Conditions for Participation in Eurekaweek is possible only by means of a written decision of the Organisation/the Eurekaweek management signed by the Organisation/the Eurekaweek management.
4. These General Terms and Conditions for Participation in Eurekaweek and any existing or future legal relations and/or disputes between the Eurekaweek management and the Participant are governed solely by Dutch law.
5. In the event of disputes, the parties will first conduct talks and make efforts to solve and settle such disputes by agreement. If the parties do not succeed in this, the dispute shall be settled exclusively by the competent judge of the District Court of Rotterdam.
